After a month of contemplating defendant’s summary judgment motion, Foley and Mansfield emerged victorious in obtaining a summary judgment dismissal for a Spokane area building supplier a month prior to trial.
The case involve allegations stemming from the purchase of asbestos-containing joint compound products from a regional building suppler. Plaintiff alleged that he purchased asbestos-containing joint compound for work remodeling a home in the 1970’s. Through discovery and investigations we established that the plaintiff purchased joint compound at a time when asbestos-free compound was available and sold in the marketplace. Plaintiff could not establish that he purchased asbestos-containing joint compound for work on the house. The Court recognized the uncertain nature of the plaintiff’s allegations and the minimal exposure in dismissing this case.
